CHATHAM, NY — A 34-year-old man has been indicted on multiple felony charges following a motor vehicle collision that seriously injured a passenger last year.
Nicholas R. Mottsey, of Accord, was arrested May 15 by the New York State Police Bureau of Criminal Investigation in Livingston.
On Oct. 29 at approximately 12:35 a.m., New York State Police at Thruway Kingston were dispatched to a one-vehicle collision on eastbound Interstate 90 near mile marker 14.5 in the town of Chatham.
An investigation by the New York State Police Bureau of Criminal Investigation in Livingston and the New York State Police Collision Reconstruction Unit determined that Mottsey was operating a 2004 Toyota with a 33-year-old female passenger from Kingston when the vehicle left the roadway and struck a rock embankment.
While on scene, troopers detected an odor of an alcoholic beverage emanating from Mottsey.
Both occupants were transported to Albany Medical Center with serious injuries.
A blood sample obtained during the investigation later revealed Mottsey’s blood alcohol content was 0.17 percent.
On May 15, a grand jury indicted Mottsey on reckless endangerment in the first degree, a class D felony; assault in the second degree, a class D felony; vehicular assault in the second degree, a class E felony; reckless endangerment in the second degree, a class A misdemeanor; operating a motor vehicle with .08 of 1 percent alcohol or more in blood, an unclassified misdemeanor; driving while ability impaired by the combined influence of drugs or alcohol and drugs, an unclassified misdemeanor; driving while intoxicated, an unclassified misdemeanor; and reckless driving, an unclassified misdemeanor.
Mottsey was arraigned May 18 in Columbia County Court and released on his own recognizance.
He is scheduled to reappear June 22 at 9 a.m.
