YORK, NY — A Wyoming County man was arrested on felony driving while intoxicated charges following a traffic stop on Main Street.
Cody Greene, 30, of Wyoming, was stopped at approximately 7:15 p.m. May 1 by Sheriff’s Deputy Jacob Cicero, who was assigned to the Sheriff’s Office STOP DWI Unit.
Cicero observed a violation of the New York State Vehicle and Traffic Law before conducting the traffic stop.
During the initial encounter with Greene, the deputy suspected he was possibly under the influence of alcohol.
A DWI investigation was conducted, which included the performance of standardized field sobriety tests.
At the completion of the investigation, Greene was taken into custody for DWI.
Greene was transported to the Sheriff’s Headquarters in Geneseo where Deputy Nicholas Evangelista of the Jail Division administered a breathalyzer test to determine his blood alcohol content.
The breathalyzer revealed that Greene had a blood alcohol content of .36 percent.
A records check showed that Greene had a prior conviction for Aggravated DWI in 2021, making this arrest a felony.
Greene was charged with felony Driving While Intoxicated, Aggravated Driving While Intoxicated and violations of the New York State Vehicle and Traffic Law.
Greene was turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention.
He was later arraigned at the Livingston County Centralized Arraignment Part at the Livingston County Jail before Town of Caledonia Justice Riggi.
The judge released Greene on his own recognizance, as the offenses do not qualify for bail under the New York State Bail Reform Act.
