GENESEO, NY — A Niagara County man was arrested on a felony charge following an investigation by the Livingston County Sheriff’s Office.
Robert Martinez, 34, was arrested April 30, 2026, for felony failure to register and verify as a New York State registered sex offender.
Investigators allege that Martinez, who is a level 1 New York State registered sex offender, failed to provide his change of address as required by law.
It was further discovered that Martinez had a previous conviction for failure to register and verify in New York State, which makes this a Class D felony.
The New York State Corrections Law section 168-F (4) states: Any sex offender shall register with the division no later than ten calendar days after any change of address, internet accounts with internet access providers belonging to such offender, internet identifiers that such offender uses, or his or her status of enrollment, attendance, employment or residence at any institution of higher education.
Martinez was located in the town of Le Roy and was taken into custody without incident.
Martinez was transported to the Livingston County Jail, where he was turned over to Central Booking Deputies for processing and pre-arraignment detention.
Martinez was later arraigned at the Livingston County Centralized Arraignment Part at the Livingston County Jail before Town of Caledonia Justice Riggi.
The judge released Martinez on his own recognizance as the offense did not qualify for bail under the New York State Bail Reform Act.
The Livingston County Public Defender’s Office represented Martinez at the court arraignment.
