FENTON, NY — A Dickinson man is facing multiple charges following a motor vehicle theft investigation.
On April 27 at approximately 11:36 p.m., Broome County Sheriff’s Office Road Patrol deputies observed a grey Volvo S40 sedan speeding out of the parking lot of a Red Apple gas station located on Albany Street.
The sedan was followed by an individual riding a motorized minibike.
Patrols began to follow the vehicles, but lost visual on them.
A short time later, they located the rider of the minibike in the area of Pine Street, who advised the deputies that his friend had stolen the car and driven to a nearby park near the Fenton Town Court, but did not have the keys.
As the deputies interviewed the witness, the owner of the vehicle ran up to report that his Volvo S40 had been stolen while he had been purchasing food at the gas station.
During the course of the investigation, the missing vehicle was located in the area of Park Street, near the Ballyhack Road walking tunnel and returned to the owner.
The victim’s cell phone, which was left in the car at the time of the theft, was also located nearby, damaged and in the brush outside of the walking tunnel.
It was determined that Kyle R. Whitmarsh Jr., 18, of Dickinson had been at the gas station and had stolen the vehicle before abandoning it.
Whitmarsh was viewed on security camera footage from the gas station entering the victim’s vehicle and driving away into view of the responding deputies.
Whitmarsh was also wanted on a charge stemming from a pursuit in the City of Binghamton on April 21.
Kyle Whitmarsh Jr. was charged with grand larceny in the third degree, a class D felony, criminal mischief in the fourth degree, a class A misdemeanor and obstructing governmental administration, a class A misdemeanor.
