BINGHAMTON, NY — A Binghamton man has been arrested following an officer-involved shooting that occurred Feb. 5 on the city’s north side.
Nicholas M. Rodriguez, 23, of Binghamton, was charged with criminal possession of a weapon in the 2nd degree, a class C violent felony; criminal possession of a weapon in the 3rd degree, a class D violent felony; criminal possession of a firearm, a class E felony; obstruction of governmental administration in the 2nd degree, a class A misdemeanor; and resisting arrest, a class A misdemeanor.
The incident occurred at 4:43 p.m. when a Binghamton Police Department Special Investigations Unit investigator was conducting an investigation in the area of Amsbry Street.
The investigator encountered Rodriguez, who was armed with a handgun, according to police.
A physical struggle ensued between the two, and the investigator fired a single gunshot from their department-issued firearm.
Rodriguez sustained a single gunshot wound to the ankle.
Aid was rendered at the scene, and Rodriguez was transported by ambulance to an area hospital for medical treatment.
A handgun was recovered from the scene.
The investigation led officers and assisting agencies to 211 Court Street to further the investigation and conduct witness interviews.
Rodriguez was discharged from the hospital and arraigned Feb. 7 in Binghamton City Court, where he was remanded to the custody of the Broome County Correctional Facility.
The Broome County Sheriff’s Office, the New York State Police, the Johnson City Police Department, the Endicott Police Department and the Port Dickinson Police Department assisted in the initial investigation.
The matter remains under investigation by the Binghamton Police Department Detective Bureau in consultation with the Broome County District Attorney’s Office.
