SARATOGA COUNTY— A Saratoga County jury has convicted a Milton man of rape following a three-week trial.
Sean M. Cherven, 39, of State Route 29 in Milton, was found guilty Monday of first-degree rape, first-degree sexual abuse and third-degree rape in connection with a March 19, 2024 incident in Milton.
The jury returned the three guilty verdicts after approximately one hour of deliberation.
Acting Saratoga County Court Judge Lorraine Diamond presided over the trial.
The prosecution called more than 10 witnesses during the trial, including the victim, who testified about the defendant’s attack.
Cherven took the stand in his own defense, maintaining he did not have sexual contact with the victim as alleged in the indictment.
A sexual assault nurse examiner testified about the victim’s examination at Saratoga Hospital following the attack.
Two witnesses from the New York State Police Forensic Investigations Center testified about scientific and DNA evidence that the jury determined linked Cherven to the assault.
Judge Diamond remanded Cherven into custody of the Saratoga County Sheriff’s Department following the verdict.
Cherven faces up to 32 years in state prison on the three convictions, which can be served consecutively when he is sentenced Sept. 9.
The case was prosecuted by Assistant District Attorneys Meghan A. Horton and Jennifer L. Pratt with District Attorney’s Office Investigator Joseph Iwaniec.
