Man arrested on rape charges in Penn Yan

PENN YAN, NY — A Farmington man was arrested following a report of sexual assault of a 15-year-old, according to Penn Yan Police.

Daniel R. Sims, 34, of Farmington, was taken into custody after police say he provided alcohol and drugs to the victim.

Police allege Sims had vaginal and oral sexual contact with the victim while the victim was under the influence and incapacitated by drugs and alcohol.

Sims, who is on parole, was taken into custody by New York State Parole Officers and turned over to Penn Yan Police.

He was charged with rape in the first degree, a class B felony; rape in the third degree, a class E felony; and facilitating a sexual performance of a child with drugs or alcohol, a class B felony.

Sims was transported to the Yates County Jail to await arraignment in Yates County CAP court.

Penn Yan Police were assisted by the Child Advocacy Center of the Finger Lakes, the Yates County District Attorney’s Office and the New York State Department of Corrections and Community Supervision.
