TROY, NY — A man was sentenced to 14 years in state prison Friday after pleading guilty to possessing a loaded assault weapon in the Town of East Greenbush.
Kenneth Phelan was sentenced by Judge Young after pleading guilty to the entire indictment charging Criminal Possession of a Weapon in the Second Degree, a class C violent felony, Criminal Possession of a Weapon in the Third Degree – Assault Weapon and Criminal Possession of a Weapon in the Third Degree – High-capacity magazine, both Class D violent felonies.
Phelan was arrested by the East Greenbush Police Department on Nov. 11, 2024, on River Road after a confrontation with a property owner regarding Phelan target shooting on the property without permission.
Phelan was taken into custody after police found him to be in possession of an unserialized AR-style rifle loaded with a high-capacity magazine and military-grade ammunition.
Phelan’s six previous felony convictions prevented him from lawfully possessing any firearm.
Judge Young sentenced Phelan as a predicate felony offender to 14 years in state prison and five years of post-release supervision.
