HAMBURG, NY — Scott A. Saracina, 66, of Hamburg, was sentenced to 25 years to life in prison as a persistent felony offender.
The sentence was handed down yesterday afternoon by State Supreme Court Justice Deborah A. Haendiges.
Saracina will be required to register as a sex offender if released from incarceration.
On Aug. 24, 2022, at approximately 1 a.m., the defendant forcibly engaged in sexual intercourse with a victim inside his apartment in the Town of Hamburg.
The defendant was known to the victim.
The victim reported the crime to police after leaving the apartment and underwent a rape kit.
In late June, a jury found Saracina guilty of one count of rape in the first degree, a Class B violent felony.
Jurors deliberated for several hours following a 5 ½-day trial.
The defendant was previously acquitted of two additional counts following a jury trial in September 2024.
Justice Haendiges declared a mistrial after jurors could not reach a unanimous decision on the rape charge.
A final order of protection was issued for the victim, remaining in effect until 2072.
