Two arrested on felony charges in Avon

AVON, NY — Two Springwater residents face felony charges following a traffic stop on Interstate 390 on May 2.

Deputy Matt VanCuran conducted the traffic stop at approximately 11 p.m. after observing violations of the New York State Vehicle and Traffic Law, according to Sheriff Thomas J. Dougherty.

The operator was identified as Samantha Rodriguez, 38, of Springwater.

A passenger in the vehicle was identified as Kyle Rodriguez, 35, of Springwater.

During the roadside investigation, deputies found an Order of Protection was in place protecting Samantha Rodriguez from Kyle Rodriguez.

Samantha Rodriguez was operating the vehicle with a suspended New York State driver’s license.

She was also found to be in possession of crack cocaine.

Both individuals were taken into custody.

Samantha Rodriguez was charged with felony criminal possession of a controlled substance in the fifth degree, aggravated unlicensed operation in the third degree and violations of the New York State Vehicle and Traffic Law.

Kyle Rodriguez was charged with felony aggravated family offense and misdemeanor criminal contempt in the second degree.

Both were transported to the Livingston County Jail for processing.

They were arraigned at the Livingston County Centralized Arraignment Part before Town of Caledonia Justice Riggi.

Samantha Rodriguez was released on her own recognizance due to the offenses not qualifying for bail under the New York State Bail Reform Act.

The District Attorney’s Office recommended Kyle Rodriguez be held on $2,000 cash bail or $4,000 bond.

Kyle Rodriguez was remanded to the custody of the Sheriff on the recommended bail and bond.

The Livingston County Public Defender’s Office represented both defendants.

The Livingston County District Attorney’s Office represented the People.

Deputies Jerry Pilkenton, Emma Bondgren and Gavin Duell assisted with the investigation.
