LIVONIA, NY — A 28-year-old man was arrested on felony Driving While Intoxicated charges following a vehicle crash investigation.
Sheriff’s Deputy Dylan Bowser was dispatched to the area of Richmond Mills Road in the Town of Livonia at approximately 9:17 p.m. on May 5 for a reported vehicle in a ditch.
Upon arrival, the deputy made contact with the operator, identified as Noah Gundy of Honeoye.
During the initial encounter, the deputy suspected that Gundy was possibly under the influence of alcohol.
A DWI investigation was conducted, which included the performance of standardized field sobriety tests.
At the completion of the investigation, Gundy was taken into custody for DWI.
Gundy was transported to the Sheriff’s Sand Point Sub-Station where Deputy Jason Page administered a breathalyzer test to determine his blood alcohol content.
The breathalyzer revealed that Gundy had a blood alcohol content of .22%.
A records check showed that Gundy had a prior conviction for DWI in 2022, making this arrest a felony.
Gundy was charged with felony Driving While Intoxicated, felony Aggravated Driving While Intoxicated and violations of the NYS Vehicle and Traffic Law.
Gundy was turned over to Central Booking Deputies at the Livingston County Jail for arrest processing and pre-arraignment detention.
He was later arraigned at the Livingston County Centralized Arraignment Part at the Livingston County Jail before Town of Conesus Justice Coyne.
The judge released Gundy on his own recognizance as the offenses do not qualify for bail under the NYS Bail Reform Act.
