SAINT ARMAND, NY — Members of the New York State Police charged Gerald J. Swinyer, 70, of Vermontville, with three counts of obstruction of governmental administration in the second degree, resisting arrest and driving while intoxicated.
On May 3, 2026, at approximately 9:16 p.m., troopers responded to State Route 3 in the town of Saint Armand for a report of an erratic driver.
Troopers located a 2023 Kia traveling in the opposite lane of traffic on State Route 3.
The vehicle was followed onto Oregon Plains Road, where a traffic stop was initiated.
The operator was identified as Swinyer.
While speaking with Swinyer, troopers observed signs of impairment.
Standardized field sobriety tests were administered, which Swinyer failed.
During the investigation, Swinyer was intermittently cooperative.
When troopers attempted to place him in handcuffs, he began to resist.
Swinyer was taken into custody and transported to State Police Ray Brook.
Upon arrival at the station, he continued to resist by pulling away from troopers and failing to comply with commands.
Swinyer ultimately provided a positive breath sample with a blood alcohol content of 0.15 percent.
He was released to a sober third party and issued appearance tickets returnable to the Town of Franklin Court.
