Rochester man arrested on felony charges in Avon

AVON, NY — A Rochester man faces felony weapons charges following a traffic stop on Interstate 390 on April 7.

Sheriff’s deputies were dispatched to a business in the Town of Geneseo at approximately 2:28 p.m. for a reported larceny of merchandise.

The suspect had left the location in a vehicle, according to the Livingston County Sheriff’s Office.

Deputy Dylan Bowser located the suspect vehicle on Interstate 390 in the Town of Avon and conducted a traffic stop.

The operator was identified as Austin McMurry, 34, of Rochester.

McMurry was found to be in possession of the stolen merchandise, an unregistered handgun and did not have a New York State pistol permit, according to Sheriff Thomas J. Dougherty.

McMurry was arrested and charged with felony criminal possession of a firearm, felony criminal possession of a weapon in the second degree and petit larceny.

He was transported to the Livingston County Jail for processing and pre-arraignment detention.

McMurry was arraigned at the Livingston County Centralized Arraignment Part before Town of Springwater Justice Johnson.

The judge released McMurry on his own recognizance as the charges do not qualify for bail under the New York State Bail Reform Act.

The Livingston County Public Defender’s Office represented McMurry at the arraignment.

The Livingston County District Attorney’s Office represented the People.
