DEPOSIT, NY — A Churchville man faces felony charges after state police say he was driving drunk with a child in his vehicle.
Trent J. Burgess, 34, of Churchville, was arrested March 15, 2026, and charged with aggravated driving while intoxicated with a child as passenger less than 16, a class E felony under Leandra’s Law.
A trooper observed a 2016 BMW M4 traveling west on State Route 17 with a vehicle and traffic infraction and initiated a traffic stop at approximately 8:34 p.m.
During the interview with Burgess, the trooper smelled an odor of an alcoholic beverage and observed characteristics associated with impairment.
The trooper also observed an 11-year-old child in the vehicle.
Burgess was asked to perform standardized field sobriety tests, which confirmed impairment.
Burgess was arrested and transported to State Police barracks in Deposit, where his reportable blood alcohol content was .12 percent.
Burgess was processed and issued appearance tickets to Sanford Town Court on May 5, 2026.
