NICHOLS, NY — New York State Police arrested a Bainbridge man on a felony charge of aggravated driving while intoxicated with a child passenger.
Michael E. Holbert, 42, of Bainbridge, was arrested March 14, 2026.
A trooper was dispatched by the Tioga County 911 Center to State Route 17/Interstate 86 near exit 63 at approximately 4:39 p.m. for a report of a motor vehicle collision.
The trooper arrived to find a 2002 Volkswagen had been traveling west and struck a guardrail, causing the vehicle to become disabled partially in the roadway.
Holbert told the trooper that he and a 4-year-old passenger were not injured.
While interviewing Holbert, the trooper smelled an odor of an alcoholic beverage.
Holbert was asked to perform standardized field sobriety tests, which confirmed impairment.
Holbert was arrested and transported to State Police Owego, where his reportable blood alcohol content was .15 percent.
Holbert was charged with aggravated driving while intoxicated with a child passenger less than 16, a class E felony under Leandra’s Law.
He was issued appearance tickets to Nichols Town Court on April 8, 2026.
