MARION, NY — State Police arrested a Rochester man on a felony assault charge following a roadside altercation that left a 67-year-old man with a fractured ankle.
Joseph Lee Blair III, 32, of Rochester, was charged with second-degree assault, a class D felony.
On Feb. 7, at approximately 5:45 p.m., State Police responded to State Route 21 in the town of Marion, Wayne County, for a report of a physical altercation.
The investigation determined that a 67-year-old man and his wife were traveling southbound on State Route 21 when they observed a delivery van stopped in the roadway facing north.
The man pulled alongside the vehicle and advised the driver that the vehicle could cause an accident if left in the roadway.
The driver, later identified as Blair, struck the man’s vehicle window with his hand.
When the man exited his vehicle, a physical altercation occurred on the shoulder of the roadway during which Blair allegedly pushed him to the ground and struck him multiple times.
Following the incident, Blair left the scene in the delivery van.
The victim’s wife captured video of the altercation.
Initially, the victim declined medical attention but later sought treatment and was diagnosed with a fractured ankle sustained during the altercation.
During the investigation, State Police identified Blair as the driver of the delivery van with assistance from the employer associated with the vehicle.
On March 7, State Police located Blair at his residence in Rochester and placed him under arrest.
Blair was processed at State Police Williamson and transported to the Wayne County Jail to await arraignment.
