Two arrested in fraud scheme in North Tonawanda

NORTH TONAWANDA, NY — Two men were arrested after allegedly attempting to fraudulently obtain more than $10,000 worth of construction materials from a local supplier.

The North Tonawanda Police Department responded to a local business on Feb. 11, 2026, for a fraud report.

Detectives determined that someone had fraudulently used a local contractor’s business account and impersonated the contractor to place an order for building materials worth over $10,000.

The contractor confirmed the order was not legitimate.

On Feb. 11 and 12, detectives coordinated with the building material supplier to attempt an arrest of the suspects.

At approximately 3:30 p.m. on Feb. 12, two suspects arrived to pick up the illegally ordered items and were taken into custody.

Luis Diaz, 37, of Depew, was charged with second-degree forgery, a class D felony; first-degree falsifying business records, a class E felony; attempted third-degree grand larceny, a class E felony; and second-degree criminal impersonation, a class A misdemeanor.

Roberto Rocha, 59, of Depew, was charged with attempted third-degree grand larceny, a class E felony.

Both suspects were held for arraignment in North Tonawanda City Court.
