Inmate charged with assault in Rutland

RUTLAND, VT — An inmate at Marble Valley Correctional Center was charged with assault upon a protected professional after allegedly spitting on a correctional officer early Wednesday.

Damien Q. Diaz, 21, of Bennington, is accused of spitting saliva that struck Correctional Officer Evan Haley’s face during an incident at 12:15 a.m.

The Vermont State Police Bureau of Criminal Investigation, Troop B-West Rutland, received a report of the assault involving exposure to bodily fluids.

Investigation determined the incident occurred when Haley attempted to take a tablet away from Diaz, who initially refused to hand over the device.

Diaz was charged with assault upon a protected professional.
