Woman arrested on trespass charge in Penn Yan

PENN YAN, NY — A woman was arrested on charges of obstructing governmental administration, resisting arrest and trespass following a landlord-tenant dispute.

Carol Briggs, 63, of Penn Yan, was taken into custody after refusing to leave an apartment that did not belong to her, according to Penn Yan Police.

Officers responded to a report of a person refusing to leave an apartment.

Police found Briggs, a family member of the landlord, inside the apartment.

Briggs was upset at the current tenant and wanted them removed from the apartment, police said.

Officers advised Briggs that a tenant had to be legally evicted in order to be forcefully removed.

The tenant, landlord and police told Briggs multiple times to leave the property or face arrest.

Briggs refused to comply with officers.

When officers told her she was under arrest, Briggs placed herself on the floor and fought against police who were attempting to handcuff and remove her, according to police.

Once handcuffed, Briggs refused to walk and had to be carried by police to the patrol vehicle.

At the police department, Briggs refused to provide any personal information to police.

Briggs was processed and released on an appearance ticket to appear in Penn Yan Village Court at a later date.
