Man charged with DWI with children in car in Southeast

SOUTHEAST — A Danbury, Connecticut man was arrested for driving while intoxicated with two young children in his vehicle during a traffic stop on Interstate 84, New York State Police said.

Irving A. Alvarez Godoy, 36, was pulled over at approximately 11:27 p.m. Oct. 3 while traveling eastbound on Interstate 84 in the Town of Southeast for violations of the New York State Vehicle and Traffic Law.

During the stop, Alvarez Godoy displayed signs of intoxication, police said.

Two children, ages 5 and 10, were in the vehicle at the time of the stop.

Alvarez Godoy was taken into custody and transported to State Police Brewster for processing.

He submitted to a chemical breath test, which yielded a blood alcohol concentration of 0.09%.

The children were safely released to a sober third party.

Alvarez Godoy was charged with aggravated driving while intoxicated with a child passenger less than 16 (Leandra’s Law), a Class E felony; driving while intoxicated, an unclassified misdemeanor; and vehicle and traffic law violations.

He was issued traffic tickets and is scheduled to appear before the Town of Southeast Court on Nov. 3 at 9:30 a.m.
