Livonia man arrested on gun, DWI charges

LIVONIA — Sheriff Thomas J. Dougherty reports the arrest of a Livonia resident on felony and misdemeanor charges following an investigation by the Livingston County Sheriff’s Office.

On Sept. 17 at approximately 10:55 p.m., Sheriff’s Deputies responded to a residence on Cleary Road in the Town of Livonia for the report of an individual outside at the residence in possession of a gun.

Responding Deputies made contact with 40-year-old Stephen McManus of Livonia who pulled into the residence while Deputies were arriving.

It was found that McManus was in possession of a handgun and does not have a valid NYS Pistol Permit.

Deputies also suspected that McManus was under the influence of alcohol.

Deputy Justin Zajicek, who is assigned to the Sheriff’s Office STOP DWM Unit conducted a DWI investigation, which included the performance of standardized field sobriety tests.

At the conclusion of the roadside investigation, McManus was taken into custody for Driving While Intoxicated.

McManus was transported to the Sheriff’s Office Headquarters in Geneseo where he was offered a breathalyzer to determine his blood alcohol content.

Deputy Robert Brooks of the Jail Division administered the test which revealed that McManus had a blood alcohol content of .14%.

McManus was charged with felony Criminal Possession of a Firearm, misdemeanor Criminal Possession of a Weapon in the Fourth Degree, misdemeanor Driving While Intoxicated and violations of the NYS Vehicle and Traffic Law.

McManus was transported and turned over to Central Booking Deputies at the Livingston County Jail for arrest processing and pre-arraignment detention.

McManus was later arraigned at the Livingston County Centralized Arraignment Part at the Livingston County Jail before Town of Avon Justice Hoffman.

The Judge released McManus on his own recognizance as the offenses do not qualify for bail under the NYS Bail Reform Act.

The Livingston County Public Defender’s Office was present and represented McManus at the court arraignment for his defense.

The Livingston County District Attorney’s Office was also present to represent the People.

Assisting with the investigation and arrest were Sheriff’s Deputy Bryan Mann and Deputy Alyssa Cornelius.
