Burke man faces 2nd DUI charge after found asleep in vehicle

BURKE — Vermont State Police arrested a 39-year-old Burke man on his second DUI charge after finding him asleep in his vehicle following reports of erratic driving.

Daniel Stuart was taken into custody at approximately 8:43 p.m. Sept. 14 after troopers located his vehicle parked at a residence on Old Farm Road.

The incident began at approximately 7:39 p.m. when Vermont State Police at the St. Johnsbury Barracks received a report of a motor vehicle operating erratically on US Route 5, traveling northbound toward Burke.

The caller reported that the vehicle was unable to maintain its lane, had crossed the center line multiple times, and nearly struck oncoming traffic.

Troopers found Stuart asleep in the driver’s seat of the suspected vehicle.

While speaking with Stuart, troopers observed signs of impairment.

Stuart was transported to the Vermont State Police St. Johnsbury Barracks for processing.

He was cited on charges of DUI and negligent operation.

Stuart was released and is scheduled to appear in Caledonia County Superior Court on Sept. 29 at 8:30 a.m.
