GREECE — Greece Police officers responded to a residence on Foster Road at approximately 1:50 a.m. Sept. 5 for a report of a male with a gunshot wound.

Officers located a 28-year-old male victim, Devon Smith, who had sustained a gunshot wound to the hip and groin area.

EMS transported Smith to Strong Memorial Hospital, where he was listed in stable condition.

Police arrested Devon Smith Jr., 28, of Greece, on charges of criminal possession of a firearm and tampering with physical evidence, both E felonies.

Police also arrested Fabion Brock, 22, of Greece, on charges of criminal possession of a weapon in the second degree, a C felony, and tampering with physical evidence, an E felony.

Investigators determined that Smith was involved in a physical altercation with his mother when his brother, Brock, intervened.

During the incident, Smith produced a firearm that discharged, striking him.

Both Smith and Brock admitted that Smith then handed the gun to Brock, who disposed of it in an unknown body of water before officers arrived.

Smith was issued an appearance ticket returnable to Greece Town Court.

Brock was remanded to the county jail and arraigned in CAP Court.
