MOUNT PLEASANT — A trooper assigned to State Police Hawthorne conducted a traffic stop on a vehicle traveling southbound on the Taconic State Parkway in the Town of Mount Pleasant for a violation of the New York State Vehicle and Traffic Law on Aug. 31 at approximately 6:48 p.m.
During the stop, the operator of the vehicle, identified as Jose A. Aliaga-Velasquez, 40, of Port Chester, displayed signs of intoxication.
Further investigation revealed that a 15-year-old child was in the vehicle at the time of the stop.
Aliaga-Velasquez was taken into custody and transported to SP Hawthorne for processing.
He submitted to a chemical breath test, which yielded a blood alcohol concentration of 0.08%.
The child was safely released to a sober third party.
As a result of the investigation, Aliaga-Velasquez was charged with aggravated driving while intoxicated with a child passenger, a Class E felony under Leandra’s Law.
He was also charged with driving while intoxicated, an unclassified misdemeanor, and a vehicle and traffic law violation.
Aliaga-Velasquez was issued traffic tickets and is scheduled to appear before the Town of Mount Pleasant Court on Sept. 4 at 9 a.m.
