CLIFTON PARK — State Police arrested Joshua Malacek, 40, of Halfmoon on charges including rape in the third degree, sexual abuse in the second degree, petit larceny, obstructing governmental administration in the second degree and harassment in the second degree.
Troopers received a report of sexual assault at about noon Aug. 6.
The investigation determined that during the previous overnight hours, Malacek allegedly sexually assaulted an adult victim who was incapable of consent in Halfmoon.
Malacek also reportedly stole items from the victim’s home.
Malacek was arrested at his home and transported to State Police Clifton Park for processing.
He was then arraigned at Halfmoon Town Court where he became highly uncooperative, kicking furniture and spitting on troopers and in the direction of the judge.
Malacek’s actions obstructed the judge’s ability to complete the necessary court proceedings.
He was remanded to the Saratoga County Correctional Facility in lieu of $100,000 cash, $250,000 bond, or $500,000 partially secure bond.
