Brewster man arrested on felony DWI charges with child in vehicle

BREWSTER — A Valhalla man was arrested on felony driving while intoxicated charges after a traffic stop with a 4-year-old child in his vehicle Aug. 10.

State Police from the Brewster barracks stopped a Ford F-350 on Main Street at approximately 8:48 p.m. for multiple Vehicle and Traffic Law violations.

The driver, Erasmo Garcia, 36, of Valhalla, exhibited signs of intoxication, police said.

Garcia failed standardized field sobriety tests administered at the scene.

He was arrested and transported to the State Police Brewster barracks for processing.

A breath sample indicated Garcia’s blood alcohol concentration was 0.08%.

The child was released safely to a sober third party.

Garcia was charged with aggravated driving while intoxicated under Leandra’s Law for having a child passenger under 16, a Class E felony.

He also faces a Class E felony charge of driving while intoxicated with a previous conviction of a designated offense within 10 years.

Garcia was additionally charged with circumventing an ignition interlock device while subject to a court order requiring the device, a Class A misdemeanor.

He was released on uniform traffic tickets and is scheduled to appear in Brewster Village Court Sept. 8 at 4:30 p.m.
