Tarrytown man charged with DWI with 4 children in car

TARRYTOWN — State Police arrested Ruben M. Fernandez Urena, 34, of Yonkers, on July 27 following a traffic stop on Interstate 87.

Troopers initiated the stop at approximately 1:46 a.m. on a gray Toyota traveling southbound near Exit 9 in the village of Tarrytown.

Fernandez Urena exhibited signs of intoxication during the interview with troopers.

He failed standardized field sobriety tests administered at the scene.

Investigation revealed four children, ages 12, 11, 7 and 5, were present in the vehicle.

Fernandez Urena was arrested and transported to State Police Tarrytown for processing.

He provided a breath sample with a blood alcohol concentration of 0.12%.

Fernandez Urena was charged with four counts of aggravated driving while intoxicated with a child passenger under Leandra’s Law, a Class E felony.

Additional charges include driving while intoxicated first offense, operating a motor vehicle with a BAC of 0.08% or higher first offense, and vehicle and traffic law violations.

He was released to a sober third party.

Fernandez Urena is scheduled to appear in Village of Tarrytown Court on Aug. 20.
