Bath man arrested on trespass, drug charges

BATH — A 33-year-old Bath man was arrested July 3 on charges stemming from entering a condemned apartment and possessing controlled substances without a prescription.

Zachariah E. Cole was charged with third-degree criminal trespass, a Class B misdemeanor, and fifth-degree criminal possession of a controlled substance, a Class D felony.

Officers with the Village of Bath Police Department observed Cole walking on State Route 415 at about 1:57 p.m. July 3 and knew he had pending charges.

Police had received a report June 27 of a male who had entered a condemned apartment where he was not lawfully allowed.

After an investigation, police identified the man as Cole and filed charges.

When Cole was taken into custody July 3 on the criminal trespass charge, a search found him in possession of Buprenorphine Hydrochloride pills and sublingual films.

Cole did not have a valid prescription for the drug and intended to sell it to another person, police said.

Cole was transported to the Bath Police Department for processing and then to Steuben County Jail for arraignment.

He was released because the charges do not qualify for bail and is scheduled to return to Bath Village Court at a later date.
