2 arrested in Elmira on child sex assault charges

ELMIRA — New York State Police at SP Horseheads announced the arrest of two people on July 2 for predatory sexual assault against a child and use of a child in a sexual performance.

Grace E. Balthazor, 33, of Elmira, and Devin G. Lavalley, 37, of Burlington Flats, were charged with predatory sexual assault against a child, an A-II felony, and use of a child in a sexual performance, a C felony.

The arrests followed an investigation into a sexual assault of a 1-year-old female victim and the video recording of the assault.

Balthazor and Lavalley were arraigned in Elmira City Court.

They were remanded to the Chemung County Jail with no bail pending future court action.

The New York State Police in Horseheads were assisted in the investigation by the State Police Computer Crimes Unit and the New York State Police at SP Sidney Bureau of Criminal Investigation Unit.
