LIVONIA — Sheriff Thomas J. Dougherty reports the arrest of a Nunda resident on felony Driving While Intoxicated charges following an investigation by the Livingston County Sheriff’s Office.
On June 14 at approximately 4:30 p.m., Sheriff’s Office Deputies were dispatched to a dining establishment in the Town of Livonia for the report of a possibly intoxicated individual who was operating a vehicle.
Deputies arrived on scene and located the vehicle in question.
Contact was made with the operator, who identified himself as 30-year-old Zachery Todd of Nunda.
Deputies suspected that Todd was under the influence of alcohol, which prompted further investigation.
Sheriff’s Deputy Hunter Little conducted a DWI investigation which included the performance of standardized field sobriety tests.
At the conclusion of the initial investigation, Todd was taken into custody for DWI.
Todd had a 2-year-old passenger in the vehicle, making this a felony arrest under Leandra’s Law.
Todd was transported to the Sheriff’s Office Headquarters in Geneseo where he was offered a chemical breath test to determine his Blood Alcohol Content.
Deputy Ryan Schirmer of the Jail Division administered the test which revealed that Todd had a blood alcohol content of 0.20%.
Todd was charged with felony Driving While Intoxicated under Leandra’s Law, Aggravated Driving While Intoxicated and Endangering the Welfare of a Child.
Todd was turned over to Central Booking Deputies at the Livingston County Jail for arrest processing and pre-arraignment detention.
Todd was later arraigned at the Livingston County Centralized Arraignment Part at the Livingston County Jail before the Town of York Justice Porter.
The Judge released Todd on his own recognizance as the offenses do not qualify for bail under the NYS Bail Reform Act.
