ERWIN — New York State Police arrested a Virginia man on weapons charges after he refused to leave a residence while armed with a handgun June 5.
Troopers from SP Painted Post responded to a report of a disturbance at a residence on Redwood Circle in the Town of Erwin at approximately 8:23 p.m.
The reporting party told troopers that a guest, identified as Clarence J. Payton, 30, of Virginia, had refused to leave the residence after being asked and was in possession of a handgun.
Troopers made contact with Payton at the residence and found him in possession of a handgun and additional extended magazines.
Payton did not have a valid New York State pistol permit.
Payton was taken into custody without incident and transported to SP Painted Post for processing.
He was then transported to the Steuben County Jail for CAP arraignment.
Police seized a Glock 17 semiautomatic handgun, two Glock 17-round magazines, one KCI USA 33-round magazine and various 9mm Luger ammunition.
Payton was charged with criminal possession of a weapon 2nd degree: loaded firearm, not in home/business, a class C felony.
He was also charged with criminal possession of a firearm, a class E felony.
Payton faces two counts of unlawful possession of certain ammunition feeding devices – not in home, first offense, a class B misdemeanor.
