ONEONTA — A 33-year-old Oneonta man was arrested Tuesday after allegedly firing a BB gun at a Norfolk Southern Railway train, according to the Otsego County Sheriff’s Office.
James J. Fulginiti was taken into custody at approximately 5:08 p.m. near the railway off State Highway 7 and Corporate Drive.
Deputies responded after Otsego County 911 dispatchers received reports of a man walking down the railway and shooting a firearm at a train.
Fulginiti allegedly fired a BB gun pistol at the train conductor compartment and struck the windshield, according to the sheriff’s office.
The train conductor was not injured during the incident, but the train windshield was damaged.
Fulginiti was charged with unlawful interference with railroad/train, unlawful propulsion of a missile at railroad trains, third-degree criminal mischief, third-degree criminal possession of a weapon, fourth-degree criminal possession of a weapon, second-degree menacing and third-degree criminal trespass.
He was processed at the Otsego County Sheriff’s Office and later turned over to Otsego County Corrections to be held for centralized arraignment.
The arrest was made with assistance from the New York State Police and Norfolk Southern Railway Police.
