Driver faces felony DWI charge after traffic stop with child in car in Cortlandt

CORTLANDT — A Yorktown Heights man faces felony charges after being arrested for driving while intoxicated with a child in his vehicle, state police said.

On May 23 at approximately 10:10 p.m., a trooper from the Cortlandt barracks stopped a 2003 Jeep traveling westbound on East Main Street in the Town of Cortlandt for multiple traffic violations.

The driver, identified as Alberto Pimentel Garcia, 41, exhibited signs of intoxication, according to police.

Garcia failed standardized field sobriety tests administered at the scene.

Investigators discovered a 14-year-old child was also in the vehicle at the time of the stop.

Garcia was arrested and transported to the state police barracks in Cortlandt for processing, where he provided a breath sample with a blood alcohol concentration of 0.13%.

The child was safely released to a sober third party.

Garcia was charged with Aggravated Driving While Intoxicated with a Child Passenger Under 16, commonly known as Leandra’s Law, an E felony.

Additional charges include Driving While Intoxicated, an unclassified misdemeanor, and multiple Vehicle and Traffic Law violations.

Following arraignment in the Town of Cortlandt Court, Garcia was released on his own recognizance.

He is scheduled to reappear in court on June 2 at 9 a.m.
