MARCY — State Police responded to a vehicle collision on the eastbound portion of I-90 at mile post marker 234.7 in Marcy at 4:13 a.m. on May 21.
Investigation revealed that Darryl Gaines, 30, from Buffalo, was operating a 2024 International tractor trailer when he fell asleep.
The vehicle exited the north shoulder and collided with a guide rail, causing diesel fluid to spill from the vehicle.
The New York State DEC Spill Response Team responded along with the State Police Commercial Vehicle Enforcement Unit.
Gaines was evaluated by EMS on scene and declined transport to the hospital.
He was issued traffic tickets for driving a motor vehicle off paved roadway, moving from lane unsafely, and crossing road hazard markings.
Traffic was diverted for a short period of time as debris was cleaned up and the vehicle removed by Clinton Collision.
