FISHKILL — A Carmel man faces felony charges after state police say he was driving drunk with a 3-year-old child in his vehicle on Interstate 84.
Emilio A. Caal Ixcotoy, 27, was arrested May 18 at approximately 10:20 p.m. when a trooper from the East Fishkill barracks stopped his 2006 Toyota for multiple traffic violations.
During the traffic stop, Ixcotoy exhibited signs of intoxication and failed standardized field sobriety tests, according to police.
Troopers discovered a 3-year-old child was in the vehicle at the time of the stop.
Ixcotoy was transported to the East Fishkill barracks where he provided a breath sample that measured a blood alcohol concentration of 0.15%, police said.
The child was safely turned over to a sober third party.
Ixcotoy was charged with Aggravated Driving While Intoxicated with a Child Passenger Under 16, commonly known as Leandra’s Law, a class E felony, as well as Driving While Intoxicated, an unclassified misdemeanor, and multiple vehicle and traffic violations.
He was issued an appearance ticket and released, scheduled to appear in the Town of Fishkill Court on June 11.
