WEST NYACK — A New York State Trooper arrested a man on felony driving while intoxicated charges after finding him in a disabled vehicle on Interstate 87 Thursday evening.
The trooper discovered Kenny Varma seated in a vehicle stopped on the left shoulder near mile marker 18.8 in West Nyack around 7:30 p.m. on May 1.
During the interaction, the trooper detected the odor of alcohol on Varma’s breath and observed other signs of impairment.
Varma failed field sobriety tests administered at the scene and was taken to State Police Tarrytown for processing.
At approximately 8 p.m., Varma refused to submit to a chemical breath test after being read the DWI refusal warnings.
An investigation revealed Varma had a prior DWI conviction within the past 10 years, resulting in felony charges.
Varma faces multiple charges including felony driving while intoxicated, refusal to submit to a chemical test, driving on the shoulder, unsafe lane change, and stopping/standing on the highway.
He was issued appearance tickets for the Town of Clarkstown Court and released to a sober third party.
