Rochester man arrested for felony DWI in Lima

LIMA — A Rochester man was arrested on felony Driving While Intoxicated charges after deputies found him slumped over in a vehicle stopped in the middle of a road in Lima.

On April 27 at approximately 2:17 a.m., Livingston County Sheriff’s Deputies responded to reports of a vehicle stopped in the roadway on Ideson Road with occupants slumped over.

Deputies identified the driver as Cody Smith, 34, of Rochester.

During the roadside investigation, deputies suspected Smith was under the influence of drugs and conducted a DWI investigation.

Smith refused to submit to a chemical test or evaluation by a Certified Drug Recognition Expert.

A records check revealed Smith had a prior DWAI Drugs conviction in 2019 and was operating the vehicle with a revoked New York State driver’s license.

Smith was charged with felony DWAI Drugs, felony Aggravated Unlicensed Operation in the First Degree, and multiple vehicle and traffic law violations.

He was arraigned at the Livingston County Centralized Arraignment Part before Town of Geneseo Justice Houston.

The judge remanded Smith to custody without bail due to having two or more prior felony convictions.
