CONESUS — A 37-year-old Mt. Morris resident was arrested on felony Driving While Intoxicated charges following a traffic stop in the Town of Conesus, according to Livingston County Sheriff Thomas J. Dougherty.
On April 27 at approximately 7:48 a.m., Livingston County Sheriff’s Deputy Justin Hilt pulled over a vehicle on West Swamp Road after observing violations of the New York State Vehicle and Traffic Law.
The driver was identified as Julio Burgos of Mt. Morris, whom the deputy suspected was under the influence of alcohol.
After conducting standardized field sobriety tests, Burgos was taken into custody for DWI.
Burgos was transported to the Livingston County Jail where a breathalyzer test administered by Deputy Ronald Loomis revealed a blood alcohol content of 12%.
A records check showed that Burgos had two prior DWI-related convictions in 2021 and was operating the vehicle with a revoked New York State Driver’s License.
Burgos was charged with felony Driving While Intoxicated, felony Aggravated Unlicensed Operation in the First Degree, and multiple vehicle and traffic violations.
Following processing at the Livingston County Jail, Burgos was arraigned at the Livingston County Centralized Arraignment Part before Geneseo Town Justice Houston.
Despite the District Attorney’s recommendation of $5,000 cash bail or $50,000 bond, the judge set bail at $1,500 cash or $5,000 bond.
The Livingston County Public Defender’s Office represented Burgos at the arraignment.
