MALTA — The Saratoga County Sheriff’s Office arrested a 40-year-old Malta man Friday following a domestic incident at the Budget Inn.
Deputies responded to the scene at 8:34 a.m. after receiving a call about an active domestic incident.
Justin J. Sherman was charged with assault in the 2nd degree and criminal possession of a weapon in the 3rd degree, both class D felonies.
Sherman also faces a class A misdemeanor charge of criminal obstruction of breathing or blood circulation.
According to authorities, Sherman is accused of intentionally causing physical injury to another person using a dangerous instrument and possessing that weapon after having been previously convicted of a crime.
He is additionally charged with intentionally impeding the normal breathing or blood circulation of another person by applying pressure to their throat or neck.
Sherman was arraigned before Judge Ellwood A. Sloat Jr. in Malta Town Court and remanded to the Saratoga County Jail pending further proceedings.
The victim was transported by EMS to Albany Medical Center for evaluation and treatment of non-life-threatening injuries.
