Man arrested in Hyde Park with loaded ‘ghost gun’

HYDE PARK — A homeless man was arrested Monday after police discovered he was carrying a loaded “ghost gun” and multiple high-capacity magazines near a local McDonald’s restaurant.

Theodore T. Lutz Jr., 37, was approached by Town of Hyde Park police officers responding to a report of a suspicious person at approximately 3:31 p.m. on March 9 at 4258 Albany Post Road.

Officers discovered Lutz had an active arrest warrant from Dutchess County Family Court.

During the interaction, police observed what appeared to be a handgun in Lutz’s waistband.

Lutz resisted arrest and engaged in a brief physical altercation with officers before being taken into custody without injuries, according to police.

A search revealed Lutz was carrying a black and gold polymer 9mm “ghost gun” loaded with a 15-round magazine and one round in the chamber.

Police also found an additional 15-round magazine, two 30-round magazines, two fixed-blade knives, a ski mask and a bandanna.

Lutz was charged with second-degree criminal possession of a weapon, a Class C felony, along with misdemeanor charges of obstructing governmental administration and resisting arrest.

Following arraignment at the Town of Hyde Park Justice Court, Lutz was remanded to Dutchess County Jail with bail set at $50,000 cash, $100,000 bond or $250,000 partially secured bond.

His next court appearance is scheduled for March 13 at 3 p.m.
