Homer woman arrested for allegedly using bear spray on neighbor, dog

HOMER — Maxine A. Malone, 60, was arrested by New York State Police on March 2 at approximately 2:37 p.m. on an arrest warrant for unlawfully possessing a noxious material.

The warrant for Malone’s arrest was signed by a judge following an incident that occurred in February.

On Feb. 11, troopers were dispatched to a dispute on Mountain View Drive in Homer.

An investigation revealed that Malone engaged in a verbal dispute with a neighbor during which she retrieved a can of bear spray from her vehicle’s glove compartment and sprayed both the neighbor and the neighbor’s dog.

Both the victim and the dog were evaluated by TLC members.

Under New York State law, carrying pepper spray for self-defense is legal, but the canister must not exceed .75 ounces and the chemical concentration of capsaicinoids must not exceed .7%.

It was determined that Malone’s canister was 7.9 ounces with a capsaicinoid concentration of 2.0%.

Malone was processed at SP Homer and then transported to the Cortland County Correctional Facility for centralized arraignment.
