HARPERSFIELD, NY — A Middleburg man was arrested Wednesday on charges he used an invalid credit card to rent equipment and failed to pay more than $3,000 in rental fees.
Mark J. Smith, 32, of Middleburg, was taken into custody Wednesday afternoon by deputies from the Schoharie County Sheriff’s Office, who were assisting the Delaware County Sheriff’s Office.
Sheriff Craig S. DuMond announced the arrest Thursday.
Members of the Delaware County Criminal Investigations Division were assigned a complaint Jan. 22 alleging Smith entered into an agreement with a business to pay a fee for the rental of equipment.
Smith used a credit card he knew was invalid to feign payment of the fee, according to the sheriff’s office.
Despite repeated attempts by the business to collect the rental fees, Smith made no further attempts to pay the fee, which totaled more than $3,000, according to the sheriff’s office.
Smith was arrested following the receipt of a warrant of arrest from the Town of Harpersfield Court.
He was charged with one count of grand larceny in the third degree, a class D felony, and one count of unlawful use of a credit card, a class A misdemeanor.
Smith was turned over to the Delaware County Jail pending arraignment at Centralized Arraignment Part Court.
