CALEDONIA, NY — A Monroe County man faces felony charges following a traffic stop in the village.
Deputy Caleb Nellis stopped a vehicle on North Street at approximately 11:38 p.m. Nov. 26 for vehicle and traffic law violations.
The operator was identified as James Cheshire, 48, of Spencerport.
Deputy Nellis suspected Cheshire was under the influence of alcohol and conducted a DWI investigation that included standardized field sobriety tests.
Cheshire was taken into custody for DWI.
Cheshire refused to submit to a chemical breath test.
Investigators determined Cheshire was operating the vehicle with a revoked New York State driver’s license due to a previous refusal to submit to a breath test.
Cheshire was charged with felony aggravated unlicensed operation in the first degree, misdemeanor driving while intoxicated and vehicle and traffic law violations.
He was transported to the Livingston County Jail for processing and pre-arraignment detention.
Cheshire was arraigned at the Livingston County Centralized Arraignment Part before Village of Mt. Morris Justice Finnigan.
He was released on his own recognizance as the offenses do not qualify for bail under the New York State Bail Reform Act.
