AVON — Sheriff Thomas J. Dougherty reports the arrest of an Avon resident on domestic related charges following an investigation by the Livingston County Sheriff’s Office.
On Sept. 28, Sheriff’s Deputies responded to an address in the Town of Avon for the report of a domestic dispute in progress.
Deputies arrived and made contact with the victim who advised the suspect, identified as 23-year-old Joshua James of Avon, was in a physical confrontation with the victim.
During the physical confrontation it is alleged that James did intentionally damage the victim’s cell phone while she was attempting to call emergency services.
James was arrested and charged with felony Criminal Mischief in the Third Degree, misdemeanor Criminal Mischief in the Fourth Degree, misdemeanor Criminal Obstruction of Breathing and Harassment in the Second Degree.
James was transported and turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention.
James was later arraigned at the Livingston County Centralized Arraignment Part at the Livingston County Jail before Town of Groveland Justice Bean.
The Judge did release James on his own recognizance as the offenses do not qualify for bail under the NYS Bail Reform Act.
The Livingston County Public Defender’s Office was present and represented James at the court arraignment for his defense.
The Livingston County District Attorney’s Office was also present to represent the People.
