UTICA — Utica Police and Fire units responded to a fight in the 800 block of Jay Street on Sept. 3 at approximately 10:10 a.m.
Officers found multiple parties with various injuries from an altercation stemming from ongoing domestic issues between a male and a female.
Police determined that Elijah Mitchell, 31, of Utica, and Duane Floyd, 40, of Utica, engaged in a physical fight.
Floyd threw Mitchell to the ground and choked him until he lost consciousness, according to police.
Floyd then kicked and punched Mitchell repeatedly while he was on the ground.
Mitchell’s girlfriend witnessed the assault and attempted to shield his body by getting on top of him.
Floyd struck the girlfriend multiple times as she tried to protect Mitchell, police said.
The investigation revealed that Mitchell, Floyd and the mother of Mitchell’s children were involved in a domestic incident on Aug. 11.
The incident occurred during a planned visitation with the children when an argument broke out between the three parties.
Mitchell grabbed a bat and attempted to strike Floyd and the woman, according to police.
Floyd and the woman tried to leave in a vehicle, but Mitchell followed and struck the car with the bat, breaking a window while the children were inside.
Warrants were filed against Mitchell for the Aug. 11 incident because he was not present when police responded.
All parties were transported to the hospital and later released on Sept. 3.
Floyd was charged with strangulation in the second degree, assault in the third degree and harassment in the second degree.
Mitchell was arrested on warrants for menacing in the second degree, criminal possession of a weapon in the fourth degree, criminal mischief in the fourth degree and three counts of endangering the welfare of a child.
