Queensbury man charged with DWI after pedestrian struck in serious crash

QUEENSBURY — The State Police are investigating a serious car versus pedestrian crash that occurred at approximately 5:15 p.m. on Friday, Aug. 29, at the intersection of Aviation Road and the Exit 19 southbound off-ramp from Interstate 87 in the town of Queensbury, Warren County.

Preliminary investigation determined that a 2016 Jeep Cherokee, operated by Brodie C. Gerber, age 25, of Lake George, exited I-87 southbound and turned east onto Aviation Road when it struck David J. Mitchell, age 45, of Granville, who was standing partially in the roadway.

Mitchell sustained multiple serious injuries, including broken legs, and was initially transported to Glens Falls Hospital before being transferred to Albany Medical Center, where he remains in critical condition.

Several witnesses provided statements indicating that Mitchell had been observed walking in and out of traffic prior to the crash.

EMS personnel who responded to the scene confirmed those observations.

Troopers on scene conducted field sobriety tests on Gerber, which he failed.

He was taken into custody and transported to SP Queensbury for processing.

Gerber submitted to a chemical breath test which revealed a blood alcohol content of .17%.

He was also evaluated at the scene by a Drug Recognition Expert.

Gerber was charged with Driving While Intoxicated and released on his own recognizance following arraignment in Warren County CAP Court.

He is scheduled to appear in Queensbury Town Court on Sept. 8 at 9:00 a.m.

The State Police Collision Reconstruction Unit responded to process the scene.

The investigation remains ongoing and additional charges are possible.
