ITALY — A 33-year-old Naples woman was arrested on felony aggravated DWI charges after deputies observed her driving erratically with a child in the vehicle on State Route 245 in the Town of Italy on Tuesday evening.
Alissa M. Cota was charged with felony aggravated DWI for having a child less than 16 years old in the vehicle, according to the Yates County Sheriff’s Office.
The arrest occurred at 7:05 p.m. Tuesday when deputies initiated a traffic stop after observing the erratic driving.
Deputies identified Cota as the driver and noted she had a child passenger in the vehicle.
Officers observed signs of intoxication and administered standardized field sobriety tests.
During the arrest, Cota attempted to physically obstruct deputies from placing her in custody, according to the sheriff’s office.
She was transported to the Yates County Jail for a chemical test and held for centralized arraignment.
In addition to the felony charge, Cota faces aggravated DWI charges for having a blood alcohol content of 0.18% or greater, driving while intoxicated with a BAC of 0.08% or greater, and common law DWI.
She was also charged with misdemeanor endangering the welfare of a child and obstruction of governmental administration.
Traffic violations include moving from a lane unsafely, not wearing a seatbelt, failing to keep right, and failing to notify the DMV of an address change.
The arrest falls under Leandra’s Law, which makes it a felony to drive intoxicated with a child 15 years old or younger in the vehicle.
