Cohoes man charged with rape of minor, held on ICE detainer

COHOES — Police arrested 35-year-old Marcio Martins-Rodrigues, a Brazilian national, Sunday following an investigation into a sexual assault of a minor.

Martins-Rodrigues was charged with first-degree rape, a Class B felony involving forcible compulsion, and second-degree rape, a Class D felony involving an actor 18 or older and a victim under 15.

He was arraigned in City Court and remanded to the Albany County Correctional Facility.

Wednesday, the Albany County District Attorney’s Office presented the case to a grand jury, resulting in a two-count indictment on the charges.

Martins-Rodrigues remains in custody at the correctional facility.

Immigration and Customs Enforcement records indicate Martins-Rodrigues was previously deported from the United States and is currently in the country illegally.

He is under removal proceedings, and an ICE detainer has been placed with the Albany County Correctional Facility.
