2 arrested in Altona domestic incident involving baseball bat, pitchfork

ALTONA — Members of the New York State Police arrested Brian D. Guerin, age 44, of Altona, for Criminal Contempt in the 2nd degree on July 19.

Additionally, Katoe L. Nephew, age 39, also of Altona, was arrested for Assault in the 2nd degree and two counts of Menacing in the 2nd degree.

On July 18, at approximately 8:29 p.m., Troopers responded to a report of a physical altercation on Alder Bend Road in the town of Altona.

The investigation revealed that Nephew and Guerin were at the residence to gather Nephew’s belongings when a verbal argument broke out between Nephew and the victim.

During the argument, Nephew grabbed a baseball bat and struck the victim multiple times.

Other individuals at the residence intervened, which led Nephew to grab a pitchfork and make threatening remarks towards the victim.

These individuals managed to take the pitchfork away from Nephew.

Upon being contacted by law enforcement, Nephew and Guerin fled into the woods.

Further investigation showed that Nephew and Guerin had a full stay-away order of protection against each other, meaning they were not supposed to be together.

Guerin was arrested and processed, then released on an appearance ticket, returnable to the Town of Altona Court at a later date.

Nephew was arrested and processed at SP Champlain.

She was arraigned in the Town of Mooers Court and released on her own recognizance.
