Man arrested on burglary charge in Auburn

AUBURN, NY — A man was arrested early Wednesday morning after allegedly attempting to break into a State Street restaurant.

Officers of the Auburn Police Department were dispatched to 96 State Street, Curley’s Restaurant, at approximately 12:41 a.m. in regards to an unwanted guest.

Upon arrival, officers spoke with a male who identified himself as Donald R. Filback.

Employees at the bar advised that Filback was trying to fight other patrons and threw a chair after being asked to leave multiple times.

Filback was then advised by officers to leave the property and that he was formally trespassed.

At that point in time Filback left the property without issue.

At approximately 2:10 a.m., an officer of the Auburn Police Department was conducting a property check of Health Central located at 37 W Garden Street.

While conducting his property check the officer heard loud banging and glass breaking in the area of Curley’s Restaurant located at 96 State Street.

The officer responded to the area where he located Filback actively attempting to break into the restaurant.

As the officer was approaching Filback, he attempted to flee the scene by jumping over a metal gate which enclosed the patio area of the restaurant.

While trying to jump over the gate it broke causing Filback to fall approximately eight feet onto the ground.

Filback was then taken into custody and transported to Auburn Community Hospital by Auburn City Ambulance due to injuries from his fall.

After further investigation, it was determined that Filback broke a window on the second floor of the building in an attempt to make entry before going to the back patio area.

Once on the patio, Filback attempted to smash his way through a back French door using chairs and food caddies.

It was determined that Filback damaged four chairs, two food caddies, and the French door on the back patio before being located by officers.

Filback was processed at Auburn Police Department headquarters and transported to Cayuga County Jail for centralized arraignment processing where he was released on his own recognizance.

Filback was charged with burglary in the third degree, a class D felony, and five counts of criminal mischief in the fourth degree, a class A misdemeanor.
